ZONING

AN ORDINANCE AMENDING CERTAIN PROVISIONS OF ORDINANCE NO. 10, SERIES OF 2001, RE: AN ORDINANCE REVISING THE ZONING REGULATIONS OF THE CITY OF GENERAL SANTOS AND PROVIDING FOR THE ADMINISTRATION, ENFORCEMENT AND AMENDMENT THEREOF AND FOR  THE REPEAL OF ALL ORDINANCES IN CONFLICT THEREWITH”,  FURTHER AMENDING FOR THIS PURPOSE CY 2001-2010 COMPREHENSIVE DEVELOPMENT PLAN OF THE CITY OF GENERAL SANTOS
 
 

Be it ordained by the Sangguniang Panlungsod, City of General Santos that:

 

SECTION 1. - The following provisions of Ordinance No. 10, Series Of 2001, Re:”An Ordinance Revising The Zoning Regulations Of The City Of General Santos And Providing For The Administration, Enforcement And Amendment Thereof And For The Repeal Of All Ordinances In Conflict Therewith”, are hereby amended as follows:

 

“ Section 3. - DEFINITION OF TERMS. In addition, this Section shall include the following terms and their definitions: to wit:

 

                         Coastal zone -  refers to  a band of dry land and            adjacent ocean space (water and submerged land in which terrestrial processes and uses directly affect oceanic processes and uses and vice-versa; its geographic extent may include mangrove, swamps, brackish water  pond, nipa swamps, estuarine, rovers, sandy beaches.  Land uses may range from fishponds, mangroves and recreational/tourism provided such uses will not result in environmental degradation.

 

                         Minor variation – refers to those projects that are evaluated for consent on merit approval.  Its impact is limited to the barangay.

 

                         Significant variation – refers to those projects that are evaluated for consent on merit approval which impact is city wide.

 

“ Section 16. PROJECTS OF NATIONAL SIGNIFICANCE. This Section shall incorporate the following provision and shall constitute second paragraph thereof.

 

       “Development plan of the ECOZONE shall be submitted to the Sangguniang Panlungsod for its approval to attain the planning objectives of Section 32- City wide Planning Objectives.”

 

Section 39. - Use Regulation referred to as Local Commercial Zone shall now be referred as Commercial-1 or C-1 and all succeeding references thereto.

 

Section 40. - Use Regulation referred to as Regional Commercial  Zone shall now be referred to as Commercial-2 or C-2 and all succeeding references thereto.

 

 

Section 42. – Use Regulation referred to as General Industrial Zone shall now be referred to as Medium Industrial Zone (MIZ) and all succeeding references thereto.

 

Section 45. – Use Regulation referred to as Eco-tourism Zone shall now be referred to as Tourism Zone (TZ) and all succeeding references thereto.

 

 

            SECTION 2: Repealing Clause. All Ordinances, Resolutions, Orders, Memoranda, and other Issuances not consistent with this Ordinance are hereby altered, amended or repealed accordingly. 

 

            SECTION 3: Separability Clause. If for certain reasons some provisions of this Ordinance are found to be invalid or unconstitutional, all other provisions hereof not affected thereby shall remain to be in full force and effect.

 

            SECTION 4: Effectivity Clause. This Ordinance shall take effect upon approval.

 

 

Enacted by the Sangguniang Panlungsod, City of General Santos, on its 89th   Regular Session held on March 13, 2003.
